Ordering and stock availability

Some products are available from stock while others are made to order. On completion of an order delivery is normally 3 -4 working days. You can request a delivery date which we will advise when the goods are ready for despatch.

Tills Innovations makes no representation as to the goods, items, products or services referred to in, or sold from, this Site as being available or suitable for use.

Cancellation

If you change your mind about anything you order, you can cancel that order free of charge so long as you do so within 14 working days of receipt of goods. You do not have to provide any reason for cancellation. Goods may be on their way to you. We will cancel any such order without charging you, with the exception that we reserve the right to make a charge for the return of the goods when necessary. In the event of cancellation we guarantee to refund your money within 30 days. This does not apply to products which have been designed as a one off for you. Those products which are deemed as a one off design is within Tills Innovations discretion.

Warranties

We aim to deliver goods of the highest quality. Where the Goods are products we warrant that they will meet their specification. All our products come with one years warranty. If you have a claim within this time we will fulfil the defective product returns policy detailed above.

The colour, size and availability of products may vary according to what nature deals us and what material is in stock. We try to confirm these details when we confirm your order prior to delivery.

Changes to the terms

Tills Innovations reserves the right to remove, modify or change, without notice, any information on this Site from time to time. Tills Innovations may change these terms at any time by posting notice of the changes on the Site. If you use the Site after Tills Innovations has posted the changes you will be bound by the new terms. You should therefore ensure that you read the terms each time you use the Site.

E-mails to you will be sent to the address you specify to us. You must only provide us with a valid e-mail address and it is your responsibility to inform us of any changes to that address.

The Conditions of Sale set forth below are exclusive and in lieu of all other Terms and Conditions appearing elsewhere or of an earlier date, Notwithstanding any terms or conditions on Buyers order forms or other documents, Buyers acceptance of any products or services identified on this Sales Order shall be deemed acceptance of the Conditions stated herein.

Contract information between Seller and Buyer is expressly conditional on Buyer's assent to the Conditions hereof, and Seller objects to any additional or inconsistent terms and conditions.

Purchasing Options

Credit Cards

At present we do not accept credit cards. Please make payment by the following methods.

Cheques, Wire Transfers & Money Orders Please pay cheque or money order, we're happy to accommodate you. Please note that we cannot ship your products until payment is received and verified, therefore, product availability may be affected by this delay. All orders will not be released for shipping before 5 business days after receipt of payment . Once payment is received, order information cannot be modified. For wire transfer information, please contact us and we will provide our bank details. Wire transfers are released for shipment upon verification from our bank. IMPORTANT: Please put your order number on your payment to ensure prompt and accurate application of payment.

Payment by Telephone We are unable to take credit cards for payment. However we are happy to provide information of other forms of payment over the phone.

Discontinued Products

At times, Tills Innovations will offer specially priced items that have been discontinued by the manufacturer. These items, clearly marked as discontinued, are not eligible for return or exchange.

Quotations and Prices

In the case of a conflict between the terms and conditions stated herein and those appearing on the face hereof, the latter shall control.

Seller's prices and quotations are subject to the following:

» All published prices are subject to change without notice.

» All quotations expire thirty (30) days after sale thereof unless previously withdrawn or otherwise specified.

» All prices quoted shall be exclusive of any charge for transportation, insurance, taxes including, without limitation, any use tax, sales tax or similar tax, license fees, customs fees, duties and other charges related thereto, and Buyer shall report and pay these items, unless otherwise agreed.

Prices quoted are only for products and services identified herein and do not include technical data, proprietary rights of any kind, patent rights or qualification, environmental tests or tests other than Seller's standard tests, nor do they include packaging other than normal domestic commercial packaging.

Published weights and dimensions are only provided for a scale of size and weight. They are simply 'in the order of' the size and weight. The actual size and weight of a product will totally depend on what material we have available. Dimension drawings can be obtained upon request at an additional charge.

Unless otherwise stated, prices are quoted Exworks. Seller's warehouse point of shipment.

Tills Innovations reserves the right to, at any time, after receipt of any order, from any customer, and without prior notice, cancel an order.

Defective Product Returns

Defective returns are only for Products purchased from Tills Innovations that are inoperable or do not function in accordance with the specifications published by the manufacturer or publisher and are covered under the manufacturer's or publisher's warranty.

All defective returns are subject to more restrictive manufacturer or publisher policies. Tills Innovations may test the Products and may return to Purchaser, at Purchaser's expense, any Products found not to be defective. Upon verification that the returned Product is defective, Tills Innovations may, at Tills Innovations sole discretion, either

» repair the defective Product,

» ship Purchaser a replacement Product.

» provide Purchaser a credit equal to the Product's invoice price or current replacement value less any applicable charges or fees.

Tills Innovations shall not be obligated to repair, replace, or issue credit to Purchaser for Products rendered defective, in whole or in part, by causes external to the Products, including, but not limited to, catastrophe, power failure or transients, over voltage on interface, environment extremes, improper use, maintenance or application of the Products or use of unauthorized parts. Purchaser shall bear all risks of loss when returning defective Products.

Discontinued Products

At times, Tills Innovations will offer specially priced items that have been discontinued by the manufacturer. Some of these items, clearly marked as discontinued, are not eligible for return or exchange.

Title Delivery. Risk of Loss and Shipping

Title to and risk of loss of all products sold hereunder by Seller shall pass to Buyer, subject to Sellers right to stoppage in transit, upon their delivery. Delivery dates are based upon Seller's best estimate in view of current and anticipated factory loads and current and anticipated raw materials and parts availability. Seller assumes no liability for loss, damage or consequential damage due to delays.

Claims

Notice of any rejection of Seller's products or services for any cause whatsoever (Including claims for shortage) shall be made in writing to Seller's address within fifteen (15) days of Buyers receipt thereof. Any and all claims not specified in such written notice shall be conclusively deemed waived by Buyer.

Buyer shall afford Seller prompt and reasonable opportunity to inspect goods as to which any claim is made as above stated.

Returned goods

In no event will Buyer return material to Seller without first obtaining authorization from Seller. Material authorized for return must be securely and safely packed and reach Seller in good condition.

Severability

This document is severable, If any provision hereof is prohibited or invalid under any law applicable hereto, it shall be ineffective to the extent of such prohibition only, without invalidating the remaining provisions hereof.

Sellers Limited Warranty and Limitation of Remedies

For those products specifically manufactured by Tills Innovations, Seller warrants its products against defects in its manufactured material and workmanship for a period of one (1) year from the date of shipment. Sellers limited warranty does not apply to products that are opened without authorization, mishandled or damaged after leaving Sellers factory, operated under conditions other than or exceeding the normal use for which they were designed and constructed, altered in any way which is detrimental to the performance or life of the products, or misapplied, misused, negligently used or involved in an accident, The statute of limitations governing any breach of this express warranty or for any other cause of action involving products or services sold under this contract shall be one (1) year. Sellers obligation under this express warranty is expressly limited to the replacement or repair of any part or parts of Sellers products and Seller shall correct any defect by repairing or replacing such defective part or parts.

Limitation of liability

This Site should only be used for information purposes. Tills Innovations shall not be liable for any damage or loss that may occur in the use of any of the information contained or advice given in this site except as stated in the terms and conditions of sale (where applicable)and to the extent that such liability cannot be excluded by law. Tills Innovations is not responsible for the Site's accuracy or its fitness for a particular purpose or the reliability of the access to this Site.

Tills Innovations is not liable for any damages or losses resulting from your use of or inability to use this Site. Tills Innovations does not guarantee that this Site will operate free of error or that it is free from computer viruses or any other contaminating computer program.

FOR BUYER'S LOSS OF PRODUCT USE OR LOST PROFITS, FOR LOSS OF TIME, INCONVENIENCE OR ANY OTHER INCIDENTAL, INDIRECT OR CONSEQUENTIAL DAMAGE SUSTAINED BY BUYER, FURTHER, IN NO EVENT SHALL SELLER BE LIABLE TO BUYER FOR ANY LOSS, DAMAGE OR HARM ARISING OUT OF THE SUPPLYING OF SELLER'S SERVICES OR PRODUCTS OR THEIR FAILURE TO OPERATE, OR FROM DEFECTS HEREIN, OR FROM BREACH OF SELLERS EXPRESS WARRANTY OR BREACH OF THIS CONTRACT OR FROM SELLER'S NEGLIGENCE RELATED TO ANY OF THE FOREGOING, IN AN AMOUNT WHICH EXCEEDS THE AMOUNT PAID BY BUYER TO SELLER FOR SELLER'S PRODUCTS OR SERVICES.

Limitation of Remedies

THE FOREGOING PROVISIONS SET FORTH SELLER'S LIMITED OBLIGATIONS TO AFFORD REMEDIES TO BUYER AND DEFINE BUYER'S EXCLUSIVE REMEDIES FOR ANY LOSS, HARM OR DAMAGE, WHETHER DIRECT, INDIRECT INCIDENTAL OR CONSEQUENTIAL RESULTING FROM THE SELLER'S SALE OR DELIVERY OF ANY SERVICES OR PRODUCTS TO BUYER.
